This property has a documented history as a bulk fuel distribution terminal going back to 1950. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This Woodinville property operated as a petroleum bulk storage and refining facility under Superior Oil, Inc. from the 1950s through the 1970s, with tank farm areas containing 35 above-ground storage tanks and 31 underground storage tanks. Remediation to date has included removal of all 66 tanks and excavation of 6,000 cubic yards of contaminated soil. Proposed future work under the Voluntary Cleanup Program includes in-situ chemical oxidation, enhanced bioremediation, soil vapor extraction, groundwater extraction and treatment, free-product recovery, and long-term monitored natural attenuation. Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
