How the Trigger Analysis is used

At Restorical Research, our Trigger Analysis is designed to discern the viability of a good faith insurance claim and inform the creative strategy that will bring insurance coverage to our clients environmental liability. This process includes:

Our Trigger Analysis synthesizes key findings from the “Big Three Data Sets” (Environmental, Site History, and Insurance Coverage) into a unified perspective. Each claim goes through this underwriting process and the Trigger Analysis is the final ‘checklist’ on coverage potential.

When projects move to Task 2, the Trigger Analysis acts as a vital roadmap that saves time and money for coverage counsel to get up to speed and develop cogent legal arguments for their written legal opinion.

Upon client approval to proceed with the tender, we work with legal counsel to address the barriers to coverage identified in the Trigger Analysis. At the same time the salient data is transferred to the tender letter (with an external cloud file) for sharing with the insurance carrier(s) upon tender.

With every piece of correspondence from the carrier(s), the Trigger Analysis is consulted and updated.

More time than not, a carrier is asking for something that has already been answered, provided or documented.

And when the requests for document production, new information or carrier questions are outside what has already been provided, Restorical Research will obtain these materials and respond to the carrier in a timely manner (goal is 2 weeks or less).
