Preliminary Site-Specific Analysis

This property has a documented history as a industrial and manufacturing facility predating 1986. Historical insurance policies issued during operations at this property and through 1986 could fund a cleanup — and recover costs already spent.

This property serves as the Waste Management of Greater Wenatchee fleet maintenance facility, housing a wash bay, shop, and outdoor parking area for large garbage trucks and equipment. The site contained four underground storage tanks — a 1,000-gallon gasoline tank, two 10,000-gallon diesel tanks, and a 1,000-gallon waste oil tank — used to fuel and service the fleet. Cleanup activities to date include the removal of three of those USTs, relocation of the waste oil tank above ground, excavation that uncovered contaminated soil and groundwater during utility trenching, and installation of two oil/water separators for ongoing pollution control; asphalt containment of remaining openings and excavations has been recommended. Cleanup work is ongoing under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The USTs at this site were constructed from single-walled steel without cathodic protection — a design type that was standard before federal regulations mandated upgrades in 1988 — and a 1997 tank tightness test confirms the gasoline tank was operational well into the post-1986 period, with installation dates almost certainly preceding it. Ecology characterizes the contamination as 'mature' or 'old spills' tied to historical fleet operations rather than any recent release, placing the origin squarely within the era when occurrence-based CGL policies carried no effective pollution exclusion. The documented remediation to date — UST removals, contaminated-soil excavation, pollution control infrastructure, and ongoing separation systems — represents costs that historical carriers who insured these fleet operations may be obligated both to recover and to fund going forward.

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Coverage and Funding
When Task 1 confirms viable coverage, Restorical works with your legal counsel to tender the claim, negotiate and secure insurance coverage. Restorical will manage the ongoing claim process, including accounting to ensure the insurance companies are funding your remediation in a timely manner.
