The Washington State Fire Training Academy — first developed in the 1980s, including years before 1986 — operates a burn pad and multiple training props where firefighting foam is used to simulate fuel-based fire response. Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The Fire Training Academy was first developed in the 1980s and, by the Ecology record, was deploying firefighting foam on its burn pad during years that preceded 1986 — before insurance market reforms introduced effective PFAS and pollution exclusions into CGL policies. Historical carriers who issued occurrence-based policies during that pre-1986 operational window may be obligated both to recover the multi-year investigation and pond treatment costs already incurred and to fund the continuing expenses of the active pre-discharge treatment system and the vendor-supplied drinking water arrangement that remain in place today.
