This property has a documented history as a gasoline service station going back to 1961. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup.

This property operated as a former Shell Oil service station from the early 1960s through the early 1970s, with five underground storage tanks installed to support fuel dispensing operations and the service station building constructed in 1961. All five USTs were removed prior to July 1989, but gasoline-range TPH and lead contamination persist in the subsurface. The site is currently under excavation, with approximately 500 cubic yards of lead-contaminated material identified, and WSDOT plans to oversee the safe handling and disposal of contaminated materials during future construction work. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
