This property operated as a gasoline service station — known as Cee Jays View Market and later View Moore Market — with at least three underground storage tanks in service prior to their decommissioning in March 1993 following a confirmed petroleum release. Remediation included excavation of 200 cubic yards (approximately 230 tons) of petroleum-contaminated soil for thermal destruction and pumping of petroleum-affected groundwater from the excavation for disposal. The project has been subject to ongoing Standard Cleanup oversight and financial considerations from 1993 through at least 2010, and cleanup is not yet complete. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. Underground storage tanks dispensing leaded fuel were operating at this property when those pre-1986 CGL policies were written, meaning the historical carriers who insured operations here may remain obligated to fund documented remediation costs: tank removals, soil excavation, groundwater disposal, and nearly two decades of continuing regulatory oversight.
