Preliminary Site-Specific Analysis

This property has a documented history as a property with a heating oil tank going back to 1983. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup.

This property was converted to the UW Consolidated Laundry Facility in 1983, the same year a 4,000-gallon fuel-oil underground storage tank was installed on the northern portion of the parcel to supply boilers or an off-property generator. A release from that UST has left diesel and oil range petroleum hydrocarbons in both soil and groundwater above cleanup levels. Site activities to date have been limited to investigation, with disposal of investigation-derived soil cuttings and purge water as the only cleanup measures completed; active remediation has not yet commenced. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The fuel-oil UST at this property was installed in 1983 — within the final years of the era when occurrence-based Commercial General Liability policies lacked effective pollution exclusions. The diesel and oil range hydrocarbon contamination documented in soil and groundwater traces directly to that pre-1986 tank and the laundry operations it served. The property owner now faces investigation and remediation costs for a release originating from infrastructure installed before 1986, and historical carriers whose CGL policies were in force during that operational window may be obligated to fund those upcoming cleanup expenditures.
