Preliminary Site-Specific Analysis

This property has a documented history as a gasoline service station going back to 1957. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property operated as Unocal Service Station 4442 from its construction in 1957, with underground storage infrastructure that included two 12,000-gallon fiberglass gasoline tanks, a 550-gallon heating oil tank, and a 280-gallon waste oil tank. Remediation conducted from 1990 to 1991 encompassed the removal of all underground storage tanks, service islands, product lines, hydraulic hoists, and a service bay drainage sump, along with excavation of 880 cubic yards of petroleum-contaminated soil; the service station building and canopies were demolished to provide excavation access. Quarterly groundwater monitoring was recommended upon completion of the remedial work. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The contamination at this site traces to storage tanks and service infrastructure installed when the facility opened in 1957 — nearly three decades before 1986, when occurrence-based Commercial General Liability policies still carried no effective pollution exclusion. Documented events including a product line replacement in 1979 and a leak tied to a hydraulic hoist replacement in 1986 anchor the contamination timeline firmly to that pre-exclusion window. The remediation costs incurred here — full UST removal, 880 cubic yards of soil excavation, building demolition, dewatering, and long-term groundwater monitoring — represent expenditures that historical carriers who issued CGL policies during the station's operational decades may remain obligated to recover and to fund going forward.

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Coverage and Funding
When Task 1 confirms viable coverage, Restorical works with your legal counsel to tender the claim, negotiate and secure insurance coverage. Restorical will manage the ongoing claim process, including accounting to ensure the insurance companies are funding your remediation in a timely manner.
