This property has a documented history as a industrial and manufacturing facility going back to 1884. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

A manufactured gas plant operated at this Tacoma property on the west slope facing the Thea Foss Waterway from approximately 1884 to 1924, producing coal gas and carbureted water gas and leaving releases of MGP tars and oils across the manufacturing and gas storage area. Oil storage tanks associated with plant operations were installed in 1912 and remained on site until 1977. Remediation has included the excavation and removal of more than 42,000 tons of contaminated soils and multiple tanks, installation and subsequent abandonment of a groundwater collection system, removal of 15 gallons of non-aqueous phase liquid (NAPL), capping of contaminated sediments, and soil treatment combined with coverage by roadway infrastructure. Sediment cap monitoring, long-term site monitoring, and operation and maintenance remain ongoing more than fourteen years after the cap was installed. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington.
