Preliminary Site-Specific Analysis

This property has a documented history as a gasoline service station going back to 1944. Historical insurance policies issued during operations at this property and through 1986 could fund a cleanup — and recover costs already spent.

This property has operated as a fuel station and automotive repair shop since at least 1944, as documented by Sanborn Fire Insurance Maps, with fuel dispensing continuing through at least 1974. Two 500-gallon underground storage tanks were excavated and removed in 2006, along with 481 tons of petroleum-contaminated soil. Remediation under the Voluntary Cleanup Program has included pumping tests, injection of 850 pounds of Oxygen Releasing Compound into groundwater, and quarterly groundwater monitoring and sampling ongoing since 2005; vapor intrusion assessments are planned to address potential soil vapor issues. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The gasoline-range TPH and BTEX contamination at this site traces directly to underground storage tanks installed at a fuel station documented as far back as 1944 — more than four decades before 1986, when occurrence-based Commercial General Liability policies were still written without effective pollution exclusions. The documented remediation costs here — UST removals, soil excavation, groundwater treatment, and years of quarterly monitoring — stem from releases tied to those pre-1986 operations, and additional expenditures for planned vapor intrusion assessment lie ahead. Historical carriers who issued CGL policies to the fuel station operators during that operational window may still be obligated to fund both the incurred and the forthcoming cleanup costs.
