This property has a documented history as a industrial and manufacturing facility going back to 1960. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.
This property has served as a trucking maintenance and parking facility since the early 1960s, with Ryder Truck Rental beginning operations at the site in 1983. An extensive fueling system comprising four 10,000-gallon underground storage tanks for diesel and gasoline was installed in the early to mid-1970s and operated continuously until decommissioning in 1999. Cleanup under the Voluntary Cleanup Program has included excavation and removal of all four USTs and associated piping, removal of 665.12 tons of petroleum-contaminated soil, and recovery of 10,000 gallons of affected groundwater. Quarterly groundwater monitoring has been ongoing since at least 2001, with future remediation plans calling for bioremediation injection and natural attenuation monitoring. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Petroleum contamination at this site resulted from failed pipe fittings and overfill releases tied to underground storage tanks installed and operated continuously from the 1970s — well before 1986, when occurrence-based Commercial General Liability policies still carried no effective pollution exclusion. The remediation cost trail here spans decades: tank removal, large-scale soil excavation, groundwater recovery, long-term monitoring, and planned bioremediation still ahead. Historical carriers who issued CGL policies during the pre-1986 operational window may be obligated both to recover costs already incurred and to fund the cleanup work that remains.
