Preliminary Site-Specific Analysis

This property has a documented history as a auto body / repair shop going back to 1975. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup.

This Tacoma medical property received VOC and petroleum hydrocarbon contamination from adjacent auto repair facilities that began operating in the mid-1970s, with contaminants migrating onto the property through a shared sewer/utility line. During redevelopment, that sewer/utility line was abandoned and filled in-place to eliminate the active contamination pathway. Soil vapor monitoring was conducted at the site from 2017 through 2020 as part of the ongoing investigation, and no active cleanup work has yet commenced. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The contamination at this property originated from auto repair operations on adjacent parcels that were active from the mid-1970s — well before 1986, when occurrence-based CGL policies with no effective pollution exclusion were the industry standard. Because the VOC and petroleum hydrocarbon releases from those facilities reached this property through a documented physical utility connection, the pre-1986 carriers who insured those auto repair operations may retain obligations tied to the resulting off-site contamination. With cleanup still pending, those historical policies represent a plausible funding source for the investigation and remediation costs this property now faces.
