This site encompasses storm sewer infrastructure beneath 7th Avenue in Olympia, operated and maintained by Olympia City Public Works. A Site Hazard Assessment completed in 2005 confirmed the presence of contamination at the site; the source of that contamination was identified as presently unknown at the time of assessment. Remediation to date has been limited to capping the contaminated area, and the site remains in Awaiting Cleanup status under Standard Cleanup. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The storm sewer infrastructure at this site predates the June 2000 upgrade that prompted renewed regulatory attention, placing the original installation and active municipal operations in the era when occurrence-based Commercial General Liability policies were the standard instrument for covering public-works liabilities. Those pre-1986 policies carried no effective pollution exclusion and may remain enforceable today. If the contamination source is traced to discharges or operations from that earlier period, historical carriers who insured the City of Olympia or its contractors during the original construction and operation of this infrastructure could be obligated to fund the investigation and remediation costs still ahead.
