This property has a documented history as a public works and maintenance facility predating 1986. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This site, located at the Carbon River entrance to Mount Rainier National Park, served as a National Park Service maintenance and operations facility supported by a gasoline underground storage tank, a heating oil aboveground storage tank, and a generator-associated aboveground storage tank. Hydrocarbon releases from these tanks were discovered in the early 1990s, prompting cleanup work under the Voluntary Cleanup Program that included removal of all three tanks and excavation of 500 tons of petroleum-affected soil in 1996. Groundwater monitoring has continued since the early 1990s, with quarterly monitoring ongoing as of 2018. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The fuel storage infrastructure at this site — gasoline and heating oil tanks supporting a National Park Service operations facility — was installed and in service well before 1986, when occurrence-based Commercial General Liability policies carried no effective pollution exclusion. Documented remediation costs include three tank removals, substantial soil excavation, and more than two decades of groundwater monitoring, all tied to releases from those pre-1986 operations. Historical carriers who issued CGL policies to operators of this facility during that window may be obligated to recover past cleanup expenditures and fund the monitoring program that continues today.
