This property has a documented history as a gasoline service station predating 1986. Historical insurance policies issued during operations at this property and through 1986 could fund a cleanup — and recover costs already spent.
This property formerly operated as a gasoline service station before its conversion to the current Jiffy Lube oil-change facility. Cleanup under the Voluntary Cleanup Program has included the removal of a 3,000-gallon underground storage tank and excavation of approximately 30 cubic yards of impacted soil, along with the in-place closure of a second 500-gallon UST using concrete slurry. Groundwater monitoring through four installed monitoring wells was initiated in 2008, and cleanup work remains ongoing. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Gasoline-range hydrocarbon contamination at this property has been attributed directly to its historical use as a service station — operations that predate 1986 and the shift away from occurrence-based Commercial General Liability coverage. The documented remediation expenditures to date — tank removal, soil excavation, UST closure, and multi-year groundwater monitoring — along with the costs of continued cleanup represent obligations that historical CGL carriers who covered the property during its gasoline-station era may be required both to reimburse and to fund going forward.
