Preliminary Site-Specific Analysis

This property has a documented history as a auto body / repair shop going back to 1961. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property operated as an automotive repair facility from at least 1961, with the site passing to Midas Realty Corporation in 1976 and continuing as the West Seattle Midas location. Contamination was associated with five hydraulic vehicle lifts and an oil-water separator used throughout those decades of service. Cleanup activities have included removal of those systems, excavation and disposal of 330 tons of impacted soil, offsite treatment of 1,460 gallons of oily water, and in-situ chemical oxidation treatment — 5,060 pounds of Persulfox injected through three newly installed groundwater remediation wells. Site investigations and groundwater monitoring ran from May 2020 through January 2021, and remedial design is planned as the next phase. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The petroleum and hydraulic-fluid contamination at this property originated from lift systems and separator infrastructure that were in service for decades before 1986, spanning multiple operators — including Midas Realty Corporation following its 1976 acquisition. Occurrence-based Commercial General Liability policies issued during that pre-1986 operational window carried no effective pollution exclusion and remain enforceable today. The remediation costs already documented here — hydraulic and separator removal, soil excavation, oily-water treatment, in-situ chemical injection, and ongoing monitoring — represent expenditures that historical carriers may be obligated both to recover and to fund as the remedial design phase moves forward.
