This property has a documented history as a auto body / repair shop predating 1986. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup.
This property was used as a chop shop — a vehicle disassembly and salvage operation — during which automotive debris, burn pit material, and an in-ground hoist were buried on an adjacent parcel. Between 2013 and 2016, remedial excavation removed approximately 10 cubic yards of contaminated soil from the burn pits, cleared the buried automotive debris, and transported 793.59 tons of excavated material for off-site disposal; excavation areas were subsequently backfilled and reseeded. The property remains enrolled in the Standard Cleanup program with further remedial action anticipated. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The hydrocarbon contamination and buried debris at this site trace to chop shop operations that predated 1986, when occurrence-based CGL policies carried no effective pollution exclusion in Washington. Although the 2013–2016 excavation work addressed the most accessible contamination, the site remains under active regulatory oversight with additional remediation costs ahead. Historical carriers whose policies were in force during the pre-1986 operational period may be obligated to fund that remaining cleanup.
