This property has a documented history as a public works and maintenance facility going back to 1983. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property served as the maintenance shop for the City of Everett's Legion Memorial Golf Course, with underground storage tanks providing diesel and gasoline fuel to maintenance vehicles. A 500-gallon diesel UST installed around 1983 was removed in 1996, followed by a 1,000-gallon gasoline UST in 1999. Cleanup under the Standard Cleanup program has included over-excavation of approximately 13 tons of petroleum-contaminated soil sent for offsite thermal treatment, pumping and discharge of 450 gallons of impacted groundwater, and in-situ application of 150 pounds of Oxygen Releasing Compound to treat residual contamination. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Petroleum contamination at this site originated from underground storage tanks installed and operated by the City of Everett years before 1986, when occurrence-based Commercial General Liability policies carried no effective pollution exclusion. The documented remediation expenditures — tank removals, soil excavation and thermal treatment, groundwater recovery, and in-situ bioremediation — were incurred to address releases tied directly to those pre-1986 fueling operations. Historical carriers who issued CGL policies during the early 1980s operational window may be obligated both to recover past cleanup costs and to fund the remaining remediation work.
