This WSDOT-owned property along the northbound I-5 corridor at East Portland Avenue in Tacoma yielded lead, chromium, and benzene contamination when excavation work began during an I-5 construction project in 2019. The contamination was pre-existing in the soil rather than a product of the construction itself. Remediation has involved excavating the impacted soil and transporting it off-site to LRI for disposal, with PBS Environmental conducting the cleanup effort under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Lead, chromium, and benzene are legacy contaminants whose presence in soil beneath a major transportation corridor strongly implies accumulation well before 1986 — the period when leaded gasoline was still in active use and occurrence-based Commercial General Liability policies had no effective pollution exclusion. Carriers who issued CGL policies to operators or contractors active at or adjacent to this corridor during that pre-1986 window may be obligated to fund the excavation and disposal costs now being incurred to address contamination that originated on their watch.
