Preliminary Site-Specific Analysis

This property has a documented history as a industrial and manufacturing facility going back to 1924. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

Belshaw Brothers, Inc. operated a commercial equipment manufacturing facility at this property from approximately 1924 until the early 2000s, producing bakery and restaurant equipment through operations that included an on-site aluminum foundry, a paint building, a welding shop, and associated warehouses. Cleanup activities have included underground storage tank removals in 1993/1994 and 2003, excavation of approximately 340 tons of petroleum-impacted soil, and operation of a dual-phase vacuum extraction system to address both petroleum and chlorinated solvent contamination in groundwater. Ongoing groundwater monitoring and treatment injections remain in place, and future remedial actions are planned as part of a multi-year redevelopment project. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Manufacturing operations at this property began in approximately 1924 — more than six decades before 1986 — and involved chlorinated solvents, leaded gasoline stored in underground tanks, and industrial chemicals associated with foundry, welding, and painting work. Occurrence-based CGL policies issued to the facility operators during those pre-1986 decades carried no effective pollution exclusion and remain enforceable today. The documented remediation costs — multiple UST removals, large-scale soil excavation, years of vacuum extraction, and continuing groundwater treatment — represent expenditures that historical carriers may be obligated to fund for both past work and the remediation still ahead.

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Coverage and Funding
