Preliminary Site-Specific Analysis

This property has a documented history as a landfill going back to 1950. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup.

This property has operated as a surplus storage yard since the 1950s, accumulating scrap metal, car bodies, and large volumes of solid waste — including materials buried in an on-site ravine and along a stream bank. A 1981 regulatory order required removal of salvageable scrap metal and car bodies, and subsequent cleanup phases in the early 1980s and late 1990s addressed hazardous products, asbestos, solid waste, petroleum-product barrels, and excavation of contaminated materials from the ravine. Despite those prior remediation efforts, the site remains in the Awaiting Cleanup stage under Washington State's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The waste disposal and storage practices that contaminated this property began in the 1950s — well before 1986, when occurrence-based Commercial General Liability policies were the industry standard and carried no effective pollution exclusion. Petroleum products, asbestos, and buried mixed waste accumulated over those pre-1986 decades represent exactly the kind of slow-accumulating release those policies were written to address. With cleanup work still ahead under the Standard Cleanup program, historical carriers who issued CGL policies during the property's early operating years may be obligated to fund the remaining remediation costs.
