A gasoline service station operated on the northwestern portion of this property from approximately 1919 to 1946, and a hotel with a 500-gallon heating oil underground storage tank occupied the site from 1914 to 1973. Cleanup activities have included removal of the heating oil tank, soil excavation in at least five areas with landfarming of impacted material onsite, and installation of a bioventing system that operated from October 1997 through October 1998. Groundwater monitoring with multiple well installations began in 1996, and the site enrolled in the Voluntary Cleanup Program in 1999 with recommendations for further groundwater treatment and continued monitoring. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Petroleum contamination at this property — including free product, gasoline-range hydrocarbons, and BTEX compounds — traces directly to underground storage tank operations that began more than six decades before 1986. Occurrence-based CGL policies issued to the station and hotel operators during those pre-1986 decades carried no effective pollution exclusion under Washington law. The documented remediation costs already incurred — tank removal, multi-area excavation, bioventing, and years of groundwater monitoring — along with the further treatment still recommended, represent expenditures that historical carriers may be obligated both to reimburse and to fund going forward.
