Preliminary Site-Specific Analysis

This property has a documented history as a gasoline service station going back to 1944. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property operated as a gasoline service station from at least 1944, with title records documenting a lease by General Petroleum Corporation beginning in 1947 and reverse directories identifying Sam's Mobil Service at the site through at least 1975. A UST basin and associated product lines from that operational era have been confirmed on the property. An investigation begun in 2019 has included soil borings, monitoring well installation, groundwater sampling, and off-site disposal of characterized soil and water wastes, with additional delineation and long-term monitoring planned for multiple future quarters. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

General Petroleum Corporation held a lease here from 1947, and Sam's Mobil Service operated the site through at least 1975 — both operators carried commercial insurance during decades when CGL policies issued in Washington had no effective pollution exclusion. Petroleum hydrocarbon contamination detected at monitoring well MW1 in 2020 is consistent with releases from that operational period, placing the triggering events squarely within those carriers' coverage windows. The ongoing investigation and remediation costs now accumulating at this site represent expenditures the historical insurers of General Petroleum Corporation and Sam's Mobil Service may be obligated to fund.

Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage. Restorical then manages the claim, including accounting, to ensure the cleanup is funded in a timely manner.
