Preliminary Site-Specific Analysis

This property has a documented history as a bulk fuel distribution terminal going back to 1931. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property operated as a bulk fuel storage facility from 1931, storing regular, premium, and unleaded gasoline, diesel, furnace oil, stove oil, and lubricating oil in large tanks — and is commonly known as the Former Mobil/West Coast Oil Bulk Plant Facility. A gasoline tank leak was documented in February 1984, and diesel contamination was detected in groundwater in 1986. Remediation has included free product recovery, a groundwater pump-and-treat system that has recovered and treated over 132,000 gallons of product and contaminated groundwater, and excavation of approximately 3,000 cubic yards of contaminated soil treated on-site by thermal treatment or bioremediation. Construction is complete; the site remains in a performance-monitoring phase under environmental covenants that restrict land use and prohibit disturbance of remaining contamination. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Bulk fuel storage operations at this site began in 1931 — more than five decades before 1986, the year pollution exclusions became standard in Commercial General Liability policies. The contamination events documented here, a 1984 gasoline tank leak and 1986 groundwater diesel detection, trace directly to that extended pre-1986 operational window. Remediation expenditures are substantial: over 132,000 gallons of product and contaminated groundwater recovered, thousands of cubic yards of soil excavated and treated, and monitoring commitments that continue under recorded environmental covenants. Historical carriers who issued occurrence-based CGL policies across more than fifty years of pre-1986 bulk fuel operations at this site may be obligated to fund both past and ongoing cleanup costs.

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Coverage and Funding
When Task 1 confirms viable coverage, Restorical works with your legal counsel to tender the claim, negotiate and secure insurance coverage. Restorical will manage the ongoing claim process, including accounting to ensure the insurance companies are funding your remediation in a timely manner.
