This property has a documented history as a public works and maintenance facility going back to 1947. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

The Port of Edmonds has operated this fueling facility since at least 1947, maintaining underground storage tanks for gasoline and diesel to support port vehicles, equipment, and vessel operations. Four USTs — a 2,000-gallon gasoline tank and a 4,000-gallon diesel tank near the Fur Breeders Building, and an 8,000-gallon diesel and a 12,000-gallon gasoline tank near the Service Building — were removed between 1992 and 1995. Remediation has included excavation of approximately 645 tons of petroleum-affected soil and the pumping and offsite treatment of 65,000 gallons of contaminated groundwater, with monitoring and status updates continuing over more than two decades. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The gasoline and diesel contamination documented at this Port facility originated from UST operations that began decades before 1986, when occurrence-based CGL policies were still the industry standard and carried no effective pollution exclusion. Detection of aged gasoline in 1991 groundwater samples confirms the releases are tied to long-running pre-1986 operations, not a recent incident. The remediation record here — UST removals, large-scale soil excavation, treatment of tens of thousands of gallons of contaminated groundwater, and multi-decade monitoring — represents expenditures that historical carriers who issued CGL policies during the Port's operational window may be obligated both to recover and to fund going forward.
