This property has a documented history as a public works and maintenance facility going back to 1961. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property was developed by the U.S. Air Force Strategic Air Command between 1959 and 1964 as an Intercontinental Ballistic Missile (ICBM) launch facility — one of nine such complexes in eastern Washington under Fairchild Air Force Base. The facility was operational from 1961 to 1965 and declared excess in 1966. Cleanup under the Formerly Used Defense Sites (FUDS) program has included removal of 100,000 gallons of underground storage tanks, excavation of ten test pits for site investigation, removal of all residual equipment via a service-salvage contract, and asbestos testing. Environmental assessment and eligibility determination have been ongoing since 1986. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
