Preliminary Site-Specific Analysis

This property has a documented history as a gasoline service station going back to 1975. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property operated as a Chevron service station with underground storage tanks installed as early as 1975, dispensing gasoline to the public alongside a food mart. Total petroleum hydrocarbons — gasoline — have been detected in both soil and groundwater, and total lead has been identified in soil, consistent with the era of leaded fuel. Remediation under the Voluntary Cleanup Program has spanned at least fifteen years to date, encompassing soil excavation, subsurface fuel vapor extraction, groundwater treatment, and extensive long-term groundwater monitoring. Cleanup work is ongoing. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Gasoline dispensing at this station began no later than 1975, more than a decade before occurrence-based Commercial General Liability policies gave way to claims-made forms with absolute pollution exclusions. The contamination documented here — petroleum hydrocarbons and lead in soil and groundwater — traces directly to fuel storage and dispensing operations conducted under those earlier policies. Fifteen-plus years of remediation costs already incurred, with cleanup still underway, represent both past expenditures that historical carriers may be obligated to reimburse and future costs they may be required to fund.

Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage. Restorical then manages the claim, including accounting, to ensure the cleanup is funded in a timely manner.
