This property has a documented history as a gasoline service station going back to 1966. Historical insurance policies issued during operations at this property and through 1986 could fund a cleanup — and recover costs already spent.
This property operated as a gasoline service station prior to 1991, with at least one 1,000-gallon underground storage tank dispensing gasoline for retail and commercial sale. In 1991–1992, cleanup work included removal of one UST, closure-in-place of another, and excavation and off-site disposal of approximately 175 cubic yards of petroleum-contaminated soil. A 2024 site assessment generated additional investigation-derived waste and confirmed that contamination persists, requiring further remediation. The property has operated as an automotive maintenance shop since the current owners purchased it in 1991. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. With cleanup restarted in 2024 and further remediation still ahead, the historical carriers who covered this property during its fueling era may be obligated both to recover past cleanup expenditures and to fund the work that remains.
