This site along the South Commercial Street corridor in Neenah has a documented history of petroleum and chlorinated solvent contamination from multiple pre-1986 industrial and commercial operations, including fuel storage and distribution facilities and dry-cleaning operations. Petroleum spills in 1974, 1978, 1982, and 1984 contaminated storm sewers, surface water, and soil, while underground storage tanks containing fuel oil and leaded gasoline operated at multiple properties before being closed or removed. Benzene concentrations in soil exceed the NR 720 soil-to-groundwater pathway standard by more than sixty times, trichloroethylene (TCE) has been identified in the subsurface with vapor intrusion concerns flagged by Wisconsin DNR, and 476 tons of contaminated soil were removed from the public right-of-way during road construction. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The petroleum spills, fuel storage operations, and dry-cleaning activities that created this contamination are all documented between 1974 and 1984, placing every identified source squarely in the pre-1986 window. The ongoing Environmental Remediation Program investigation, groundwater assessment, vapor intrusion evaluation, and remediation of this multi-source corridor represent substantial future costs that those historical carriers may be obligated to fund.
