This property served as a truck, bus, and trailer service and repair facility from the 1970s through 2024, with operations that included a 5,000-gallon buried holding tank collecting wastewater from repair and paint bays. A 2018 Phase II Environmental Site Assessment confirmed groundwater contamination exceeding Wisconsin NR 140 standards, including 1,4-dichlorobenzene, arsenic, lead, tetrachloroethene, and multiple other volatile organic compounds across several monitoring wells. Subsequent remediation under Wisconsin DNR Environmental Remediation Program oversight has included excavation of more than 280 tons of contaminated soil, supplemental site investigations with permanent NR 141 monitoring wells, and a case closure review requested in early 2026. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Vehicle service and repair operations at this property began in the 1970s, and throughout that pre-1986 period hazardous substances from repair bays and a buried 5,000-gallon wastewater holding tank were being introduced into soil and groundwater. Continued site investigation, groundwater monitoring through permanent NR 141 wells, any further remediation, and the regulatory compliance work required to achieve Wisconsin DNR Environmental Remediation Program closure standards represent ongoing and future cost obligations that the CGL carriers insuring those pre-1986 operations may be obligated to fund.
