This property has a history of industrial manufacturing operations spanning decades before 1986, with a licensed Treatment, Storage, and Disposal Facility (TSDF) established under RCRA corrective action since 1982. A 1984 Site Investigation Report documented soil and groundwater contamination near an on-site landfill, identifying chlorinated solvents including trichloroethylene (TCE), volatile organic compounds, polycyclic aromatic hydrocarbons, metals, and petroleum compounds. Groundwater monitoring has been conducted on a quarterly and annual basis since at least 1996, and an active hydraulic control and treatment system continues to operate under Wisconsin DNR Environmental Remediation Program oversight, with system modifications as recently as 2025. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The industrial manufacturing operations that generated contamination at this site were well established before 1986, with documented soil and groundwater impacts dating to at least the early 1980s. The ongoing groundwater treatment, hydraulic control, vapor intrusion assessment, and long-term monitoring required under Wisconsin DNR oversight represent substantial future costs that those historical carriers may be obligated to fund.
Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage.
