This property has been in continuous industrial use since the early 1920s, with manufacturing operations involving metals processing, acid storage, and electrical component production documented by Sanborn fire insurance maps and a 1981 EPA hazardous substance notification. Contaminants including lead, PCBs, chlorinated solvents (TCE, PCE), and other volatile organic compounds have been confirmed in soil and groundwater, with lead-contaminated soil removed from the adjacent public right-of-way during road reconstruction in 2010. Sub-slab vapor intrusion investigations conducted from 2020 through 2026 have confirmed chlorinated solvent vapors migrating into multiple residential properties off-site, and sub-slab depressurization systems have been installed at both on-site and off-site buildings as part of the ongoing Wisconsin DNR Environmental Remediation Program case. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Industrial manufacturing at this site began approximately six decades before 1986, with metals processing and chemical operations generating contamination throughout the facility's pre-1986 operational history. The ongoing off-site vapor intrusion investigation, residential mitigation systems, groundwater remediation, and sewer air monitoring represent substantial future and ongoing costs that those historical carriers may be obligated to fund.
Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage. Restorical then manages the claim, including accounting, to ensure the cleanup is funded in a timely manner.
