This property operated as a municipal landfill receiving incinerator ash and street and demolition debris from 1960 through 1972, after which it was graded and covered with clean fill in the early 1980s under WDNR closure regulations. A 1986 environmental assessment discovered volatile organic compounds — including trichloroethylene (TCE), tetrachloroethylene (PCE), and other chlorinated solvents — in the southern portion of the landfill. Groundwater contamination exceeding WDNR enforcement standards has migrated off-site to the east-southeast, with 37 monitoring wells installed across the landfill, adjacent school grounds, residential subdivisions, and a nearby cemetery. Vapor intrusion investigations are ongoing at school and residential buildings, with the most recent vapor sampling conducted in 2024, and a hydrological study has identified potential impacts to a nearby surface water body. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Landfill operations at this site ran from 1960 through 1972, with all waste disposal occurring well before 1986. The extensive groundwater monitoring network, ongoing vapor intrusion assessments, and remediation work required to address off-site contamination across multiple properties represent substantial future costs that those historical carriers may be obligated to fund.
