This property was developed in the late 1800s, with Sanborn fire insurance maps from 1887 confirming multiple structures on site, and it operated as a convalescent home from the 1950s through the early 2000s. Historical heating systems relied on coal and fuel oil, with physical evidence including staining in the basement boiler room, coal fragments in crawlspaces, and a coal chute, and polycyclic aromatic hydrocarbons (PAHs) and lead contamination consistent with decades of coal and fuel oil use have been confirmed in soil and groundwater. Phase II investigation found PAH concentrations exceeding Wisconsin DNR NR 140 Enforcement Standards in groundwater — including benzo(a)pyrene, benzo(b)fluoranthene, and chrysene — and the Wisconsin DNR has required additional groundwater investigation under an approved Site Investigation Work Plan. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Coal and fuel oil heating operations at this property date to the late 1800s and continued through the facility's decades of use as a convalescent home, placing the contaminating activity well before 1986. The additional groundwater investigation, site remediation, and long-term monitoring required under Wisconsin DNR Environmental Remediation Program oversight represent future costs that those historical carriers may be obligated to fund.
