Preliminary Site-Specific Analysis

This property has a documented history as an industrial and manufacturing facility going back to 1852. Historical insurance policies issued during those prior operations and through 1986 could help fund the multi-phase investigation and remediation work ahead under Wisconsin DNR oversight.

This property has been in industrial use since 1852, when wagon manufacturing operations began and grew into one of the largest such facilities in the world by 1900 — with forge rooms, painting rooms, and extensive material storage across the site. Pike Creek was filled with contaminated material in the late 1950s across the northern portion of the property, and fill containing foundry sand, slag, and crushed brick was placed throughout the site during decades of development. Multiple PAH compounds exceed Wisconsin DNR NR 140 Enforcement Standards in groundwater, with vinyl chloride and benzene also detected above regulatory thresholds, and a 2025 Site Investigation confirmed VOC, PAH, and metals contamination concentrated in the northwest corner of the site. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Industrial operations at this property began in 1852 and continued for more than 130 years before 1986, a period during which wagon manufacturing, forge work, painting operations, and filling of the Pike Creek channel with foundry sand, slag, and other industrial byproducts introduced contamination now confirmed in subsurface soils and groundwater across the site. The ongoing site investigation, remediation of VOC, PAH, and metals contamination, groundwater cleanup to meet NR 140 Enforcement Standards, and long-term monitoring required under Wisconsin DNR Environmental Remediation Program oversight represent future costs that the historical pre-1986 carriers for the businesses that operated here may be obligated to fund.

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether viable insurance coverage exists to fund the cleanup, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Coverage and Funding
When Task 1 confirms viable coverage, Restorical works with your legal counsel to tender the claim, negotiate and secure insurance coverage. Restorical will manage the ongoing claim process, including accounting to ensure the insurance companies are funding your remediation in a timely manner.
