This property operated as an automotive repair, painting, and fueling facility from at least 1949, as confirmed by Sanborn fire insurance maps, with continuous auto body operations documented through approximately 2011. Two 1,000-gallon gasoline underground storage tanks were installed in the 1940s and removed in 1974 without closure documentation, and a 1987 hazardous waste small-quantity generator notification confirms chemical use during the pre-1986 period. A 2010 site investigation confirmed trichloroethylene (TCE) in groundwater at 8.4 µg/L — exceeding the Wisconsin NR 140 Enforcement Standard of 5 µg/L — and lead in groundwater at 108 µg/L, consistent with decades of degreasing solvent use in auto body operations. The extent of contamination has not been fully delineated, and vapor intrusion and off-site migration risks remain unevaluated under the Wisconsin DNR Environmental Remediation Program. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Automotive repair, painting, and fueling operations at this site began in the late 1940s and continued for nearly four decades before 1986, placing the contaminating activity squarely in the pre-1986 window. The investigation to delineate the full extent of TCE and lead contamination, vapor intrusion assessment, off-site migration evaluation, and remediation work ahead represent future costs that those historical carriers may be obligated to fund.
Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage.
