This property has a documented history as a public works and maintenance facility going back to 1890. Historical insurance policies issued during those prior operations and through 1986 could help fund the multi-phase investigation and remediation work ahead under Wisconsin DNR oversight.

The Wisconsin Piers area along Superior's shoreline served as an industrial working waterfront from the late 1890s, with operations including shipbuilding and grain terminal activities, and extensive industrial fill — slag, coal, cinders, brick, tar, and metal — was deposited to create made land from the late 1800s through 1951. Investigations have confirmed widespread contamination including polycyclic aromatic hydrocarbons (PAHs), heavy metals with lead concentrations reaching 4,340 mg/kg in soil, mercury, diesel-range organics, chlorinated solvents (TCE, PCE), and polychlorinated biphenyls (PCBs), with groundwater at 48 of 52 sampling locations exceeding Wisconsin DNR NR 140 Enforcement Standards for PAHs and multiple metals. The site carries a Historical Waste Site designation under the Wisconsin DNR Environmental Remediation Program, and a Contaminated Groundwater Contingency Plan has been prepared to manage dewatering during ongoing remediation work. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
