A dry-cleaning facility operated at this location and was already closed when the Wisconsin DNR opened a contamination case in 1995, categorizing the release as historic. Tetrachloroethylene (PCE) and other chlorinated solvents — chemicals characteristic of dry-cleaning operations — have been confirmed in soil vapor, and off-site vapor intrusion has been documented at a nearby residential property where PCE concentrations in sub-slab vapor exceeded Wisconsin DNR Vapor Risk Screening Levels. A vapor mitigation system was installed at the off-site property in 2023, and Wisconsin DNR approved it as an interim action with long-term maintenance requirements and continuing obligations applied in 2025. Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The dry-cleaning operations that caused the PCE contamination at this site were already described as historic when the case opened in 1995, placing the contaminating activity in the pre-1986 window. The ongoing vapor mitigation system maintenance, long-term monitoring, and any additional investigation and remediation required under Wisconsin DNR Environmental Remediation Program oversight represent future costs that those historical carriers may be obligated to fund.
