This property in Green Bay has been in continuous use since at least 1883, with a filling station operating at the site from as early as 1907 through the mid-to-late 1960s and industrial operations — including a tin shop, warehouses, and railroad spur infrastructure — documented from at least 1936. Decades of industrial activity produced contamination including PAHs, VOCs such as tetrachloroethylene (PCE), PCBs, and heavy metals, with a historical waste site designation confirming disposal of glass, rubber, coal, foundry sand, and slag before 1970. Phase II and Limited Site Investigation work has confirmed groundwater contamination exceeding Wisconsin NR 140 Enforcement Standards for multiple VOCs, PAHs, and total PCBs, with free product (LNAPL) observed in one well and arsenic, barium, and lead exceeding Preventive Action Limits across multiple monitoring locations. The site remains an active Wisconsin DNR Environmental Remediation Program case with investigation and remediation ongoing. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Industrial and fueling operations at this property began more than a century before 1986 and continued through decades of pre-1986 activity, placing the origin of contamination squarely in the pre-1986 window. The extensive groundwater investigation, free-product recovery, and site-wide remediation required to address confirmed exceedances of NR 140 standards represent future costs that those historical carriers may be obligated to fund.
