This property has been in continuous industrial use since at least 1955, when metal plating and finishing operations began, though earlier industrial activities at the site — including paper manufacturing, welding and boiler works, and lumber and coal yards — date back to 1883. Chromium, cyanide, cadmium, VOCs, TCE, PAHs, and PCBs have been confirmed in soil and groundwater, consistent with decades of plating solution handling and direct discharge to the municipal sewer system. Groundwater contamination has migrated off-site to adjacent properties, with elevated cyanide and thallium concentrations detected beyond the property boundary, and Wisconsin DNR issued a vapor intrusion and TCE reminder letter in 2021 reflecting ongoing TCE in groundwater. Multiple rounds of groundwater sampling have been conducted under the Wisconsin DNR Environmental Remediation Program, with monitoring events documented through 2026. That history could support an insurance coverage claim against the carriers who issued policies more than 40 years ago — coverage that could help fund the cleanup ahead.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Wisconsin — and those policies may provide coverage that remains enforceable today. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
