This property was first developed in approximately 1948 as a Lynden Transport facility for truck repair, maintenance, and manufacturing, with four underground storage tanks installed at about that time. Operations continued at 8631 Depot Road from 1948 through 1979, with a 10,000-gallon diesel UST abandoned in the early 1980s and a 20,000-gallon diesel UST also installed during the site's operational history. Confirmed groundwater contamination — including benzene and petroleum-diesel compounds exceeding MTCA Method A cleanup levels — has migrated off-site to the adjacent Apple Valley Apartments property. Cleanup is underway. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
