Shell Oil Company owned this property and operated a petroleum storage and distribution facility here from 1944 until 1994, with storage tanks installed in 1944 and 1951 and loading racks added in 1979. A 1992 Agreed Order documented spill events from 1977 through 1981, and a 1999 Consent Decree formalized cleanup obligations tied to decades of operations at the site. Contamination in groundwater and surface water includes petroleum hydrocarbons, polycyclic aromatic hydrocarbons, benzene, halogenated organics, metals, PCBs, and pesticides, with dense non-aqueous phase liquid periodically observed in monitoring wells. Cleanup is underway under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
