The Endicott School District Bus Garage operated a 1,000-gallon steel single-wall underground storage tank for bus fleet fueling on Elementary Road. When the UST was removed in July 1989 as part of a district-wide tank replacement program, inspectors found corrosion perforations in multiple places across the lower third of the tank — damage consistent with decades of service. Soil sampling beneath the tank revealed petroleum hydrocarbon concentrations as high as 33,000 mg/kg, and BTEX compounds were detected in monitoring well water samples across an approximately 4,000-square-foot area of contaminated soil and groundwater. Cleanup is underway under Washington's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
The severity of corrosion found on the steel UST at removal — multi-point perforation of the tank's lower third by 1989 — indicates the tank had been in service since the 1960s or 1970s, well within the era when occurrence-based Commercial General Liability policies were standard and carried no effective pollution exclusion. The petroleum contamination in soil and groundwater at this site traces directly to that long-operating UST, and the remediation costs associated with addressing 33,000 mg/kg TPH concentrations and benzene-impacted groundwater represent expenditures that historical carriers may be obligated both to recover and to fund going forward.
