Northern Pacific Railroad developed this Tacoma yard just prior to the turn of the twentieth century for engine maintenance, freight car repair, and rail cargo storage. A 1982 historic land use survey identified the property for environmental study, and the U.S. EPA designated the surrounding area as a Superfund site in September 1983. Contamination from long-term railroad operations — metals and heavy oils — was discovered during construction activities in the early 1990s, and a 1999 Site Hazard Assessment confirmed the primary contamination stems from historical operations rather than a separate 1998 diesel spill. The site is currently awaiting cleanup under Washington's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Railroad operations at this yard began nearly a century before 1986, the year occurrence-based Commercial General Liability policies stopped reliably covering pollution claims. The metals and petroleum contamination detected in groundwater here traces directly to decades of engine maintenance and freight operations — exactly the type of long-duration industrial release that pre-1986 CGL policies were written to address. With cleanup costs still ahead — investigation, design, and remediation of contaminants above MTCA Method A cleanup levels — historical carriers whose policies were in effect during the yard's operational history may bear an obligation to fund that work.
