Preliminary Site-Specific Analysis

This property has a documented history as a bulk fuel distribution terminal predating 1986. Historical insurance policies issued during those prior operations and through 1986 could fund a cleanup — and recover costs already spent.

This property operated as the Leid Ford Chevron bulk fuel distribution facility in Walla Walla's petroleum distribution corridor, housing five large aboveground storage tanks with capacities of 19,000 to 20,000 gallons each. All five ASTs were removed in January 2016, and the site entered the Voluntary Cleanup Program. Groundwater sampling has confirmed TPH-Dx contamination exceeding MTCA Method A cleanup levels in 15 to 16 of 19 monitoring wells, with light non-aqueous phase liquid present in multiple wells and naphthalene vapor intrusion exceeding cancer screening levels in indoor air and sub-slab soil gas. Cleanup work is ongoing. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

The petroleum contamination at this facility — benzene, diesel-range hydrocarbons, polycyclic aromatic hydrocarbons, and naphthalene — stems from bulk fuel storage and distribution operations conducted under multiple operators, including Leid Ford, Chevron, and Powell Distributing, predating the 1986 shift away from occurrence-based CGL coverage. The scale of documented contamination — cleanup-level exceedances across nearly all monitoring wells, free product in the aquifer, and vapor intrusion into occupied spaces — represents substantial remediation expenditures that historical carriers who issued policies during the facility's pre-1986 operating years may be obligated both to recover and to fund going forward.

Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage. Restorical then manages the claim, including accounting, to ensure the cleanup is funded in a timely manner.

What We Look For

  • Historical insurance policies (pre-1986)
  • Policy numbers, carrier names, and coverage periods
  • Connection between contamination timing and policy period
  • Evidence linking cleanup obligation to insured activity

What We Deliver

  • Historical Coverage Chart
  • Trigger Analysis & Property/Policy Nexus
  • Coverage strategy with recommendations
  • Insurance funding for your remediation
  • Claims Management & Forensic Accounting

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Coverage and Funding
When Task 1 confirms viable coverage, Restorical works with your legal counsel to tender the claim, negotiate and secure insurance coverage. Restorical will manage the ongoing claim process, including accounting to ensure the insurance companies are funding your remediation in a timely manner.
