The BPA SnoKing Substation is a federal power-transmission facility whose original capacitors were PCB-bearing — and since PCB manufacturing was banned in 1979 under TSCA, those capacitors were necessarily installed before that date. Over the station's operational life, failed PCB capacitor cells were replaced with non-PCB units, and pre-project site walks documented widespread aged oil staining across the property. Site investigations have confirmed PCBs and petroleum products in both groundwater and surface water; the site is currently awaiting cleanup under Washington's Standard Cleanup program. Why Historical Insurance Policies May Be Accessible
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. The PCB contamination at this substation traces to electrical equipment installed no later than the late 1970s — well within the era when occurrence-based Commercial General Liability policies carried no effective pollution exclusion. The cleanup costs the property now faces — investigation, remedial design, and full-scale remediation of PCBs and petroleum products in groundwater and surface water — could plausibly be funded by historical carriers whose CGL policies were in effect during the decades when PCB-bearing capacitors were in active service and contaminants were migrating into the subsurface.
