Preliminary Site-Specific Analysis

This property has a documented history as a industrial and manufacturing facility predating 1986. Historical insurance policies issued during operations at this property and through 1986 could fund a cleanup.

This railroad corridor near Kelso has been in continuous operation since the 19th century, running through predecessor lines — Great Northern and Northern Pacific — before Burlington Northern's 1970 formation and its successor BNSF Railway. In November 2003, a train collision at this location released approximately 32,460 gallons of petroleum, contaminating groundwater and surface water with petroleum products and diesel. The Columbia River lies approximately 350 feet from the release site, and 833 residents are served by groundwater sources within two miles. The site is awaiting cleanup under Washington's Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.

Why Historical Insurance Policies May Be Accessible

Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.

Railroad operations at this corridor predate 1986 by roughly a century, placing them squarely within the era when occurrence-based Commercial General Liability policies covered pollution claims without effective exclusion. The petroleum release here — over 32,000 gallons contaminating groundwater and surface water near the Columbia River — has generated cleanup obligations that could be funded through historical CGL policies issued to the railroad operators during their decades of pre-1986 operations. With remediation still ahead and environmental exposure extending to both groundwater and a major waterway, the potential recovery from those historical policies is substantial.

Restorical's role is to locate viable historical policies, determine whether a successful coverage claim is possible, and assist our clients and their legal counsel to obtain insurance coverage. Restorical then manages the claim, including accounting, to ensure the cleanup is funded in a timely manner.

The Restorical Proven Process

Task 1 — Research and Analysis
Restorical searches for viable historical insurance policies, researches the site history, analyzes the contamination impacts, and underwrites potential coverage — including a proprietary trigger analysis. At the end of Task 1, we provide a clear yes or no on whether a successful cost recovery is possible, along with a strategy and recommendation specific to your situation, even if you are not the policyholder.
Task 2 — Coverage and Funding
When Task 1 confirms viable coverage, Restorical works with your legal counsel to tender the claim, negotiate and secure insurance coverage. Restorical will manage the ongoing claim process, including accounting to ensure the insurance companies are funding your remediation in a timely manner.
