This waterfront property operated as a boat building, maintenance, and repair facility from 1947 through 2009, beginning when Carl and Astrid Anderson founded Fisherman's Boat Shop under a Port of Everett lease. Ownership transitioned through Richard Eitel in 1959 and incorporation as Fisherman's Boat Shop Inc. in 1977 before the business was renamed Everett Shipyard Inc. in 2001. Shipyard operations over six decades introduced extensive contamination — metals, halogenated organics, base/neutral/acid organics, pesticides, and PAHs — into groundwater, marine sediment, and surface water, prompting a Standard Cleanup under an Agreed Order with Ecology. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Nearly four decades of this facility's operational history — from 1947 through 1985 — fall within the era when occurrence-based Commercial General Liability policies carried no effective pollution exclusion in Washington. The metals, halogenated organics, and PAH contamination documented in groundwater and marine sediment originated from boat-building and repair operations that were well underway during that pre-1986 coverage window.
