This site was developed as a rail yard in the early 1900s, with tracks extended to Auburn in 1909 and the Auburn Railyard opening in 1915 as the western freight terminal for the Northern Pacific Railroad. Facilities included a roundhouse, fueling stations, engine wash facilities, and wastewater disposal ponds, with underground storage tanks holding several hundred thousand gallons of bunker fuel, diesel, gasoline, and cleaning solvents. USTs were removed in the late 1980s, and investigations beginning in 1986 revealed a groundwater plume containing TPH-D, TPH-O, benzene, PCE, TCE, and LNAPL free product at thicknesses up to 5.6 feet — all exceeding MTCA Method A cleanup levels. The site is currently awaiting cleanup under the Standard Cleanup program. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
Railroad operations at this property date to 1909 — more than seven decades before the 1986 shift away from occurrence-based Commercial General Liability policies. The contamination identified here — petroleum hydrocarbons, chlorinated solvents, and free product in groundwater within Auburn's wellhead protection zone — traces directly to fueling, maintenance, and solvent-handling activities conducted under those pre-1986 policies. The cleanup costs this site now faces could plausibly be funded by historical carriers whose occurrence-based CGL policies were in effect during the decades of active railyard operations.
