This property was used as a dump site for a contractor's vehicle maintenance activities beginning in the early 1980s, with waste disposal including a burn pit on the premises. A 2003 Site Hazard Assessment identified soil contamination — heavy oil and cadmium among the contaminants — attributed directly to those vehicle maintenance and burn pit operations. Multiple contaminant classes have been detected at the site, including halogenated organics, petroleum products, metals priority pollutants, and non-halogenated solvents, with suspected migration to groundwater and surface water. The property sits 700 feet from Rock Creek and 510 feet from the nearest drinking water well, and cleanup under Ecology's Standard Cleanup program has not yet commenced. That history could support an insurance cost recovery claim against carriers who issued insurance policies 40+ years ago.
Pre-1986 Commercial General Liability (CGL) policies were occurrence-based and did not contain an effective pollution exclusion in Washington. If contamination occurred while those policies were active, those historical insurance carriers may still have a legal obligation to fund the cleanup costs, even if the business closed or the property changed hands.
